HCG Laws – Are Online HCG Clinics Legal?

February 5, 2009

The question of whether online medical weight loss clinics offering HCG are operating within the parameters of the law often comes up.  Do HCG Laws permit or forbid this practice?

If you have an email account, you most likely have received SPAM emails offering prescription medications from various sources.

Since HCG is a prescription drug, is it legal to sell it online?  What about an HCG weight loss clinic that will prescribe HCG sight-unseen?  Is completing an online ‘medical history form’ enough to write a valid, legal prescription for hCG?

From the FDA.gov website:

“Some Websites offer to prescribe medication
based only on a questionnaire. Is this a safe practice? Is it legal?

Unlike the traditional relationship between a patient and the patient’s
health care professional, some online practitioners issue prescriptions in
the absence of a physical examination or direct medical supervision. According
to the American Medical Association, a health care professional who offers
a prescription for a patient the practitioner has never seen before and based
solely on an online questionnaire generally has not met the appropriate medical
standard of care. As a result, patients may receive a drug that is inappropriate
for them to use and may sacrifice the opportunity for a correct diagnosis
or the identification of an underlying medical condition for which use of
the prescription drug may be dangerous.

It is a violation of the Federal Food, Drug, and Cosmetic Act to dispense
prescription drugs without a valid prescription. FDA will work with the states
to determine the validity of online prescriptions and to bring enforcement
actions under state law, federal law, or both, as appropriate. In addition,
several state boards of medicine have ruled that such practice is medical
misconduct and have fined and suspended the licenses of health care practitioners
who have prescribed drugs in this manner.”

So what does that mean?

The Government has a 3 part argument:

1) Under federal and state law, for a doctor to be acting in the usual
course of professional practice
, there must be a bona fide
doctor/patient relationship

2) Completing a questionnaire that is then reviewed by a doctor hired
by the Internet Pharmacy could not be considered the basis for a
doctor/patient relationship

3) A prescription based on an online questionnaire is not valid.

Even though this seems cut-and-dry, the fact is the DEA doesn’t have the authority to determine medical standards.

This has left the practice of online prescribing difficult to enforce on the Federal level, and now State Laws are being used to make the case that online prescribing violates Federal Law (namely, the Controlled Substances Act).

Based on the theory that since numerous States prohibit online prescribing, and a violation of State Law violates the ‘Usual Course‘ provisions of the Controlled Substances Act, this means the online prescription isn’t valid.

HOWEVER, this theory has the problem that except for Nevada and Virginia (at the time of this writing), no State says an online prescription is invalid.

Instead, there are around 28 States that address the problem by the State Medical Board calling it ‘unprofessional conduct’, which could result in disciplinary action including stiff fines, penalties or loss of medical license.

Until the laws are clarified regarding whether an ‘online encounter’ is a “sufficient examination” and “establishment of a valid physician/patient relationship”, enforcing current laws are difficult.

There are currently around 20 States that do not have provisions for enforcing ‘unprofessional conduct’.

Things are tightening up from State to State, so any existing States that are lax will probably adopt the model of other States that DO have provisions to enforce these requirements of “sufficient examination” and “establishment of a valid physician/patient relationship”.

This much is clear: the government does not like online prescribing and is doing what it can to prosecute it.

Even the “careful” distributors of online prescriptions often have problems
in their business models, such as selling to minors or having a
single doctor review hundreds or thousands of ‘online questionnaires’ per
day.

It is easy for the government to argue that
the prescription fails the basic standards of medical care and
therefore the distribution violated the Controlled Substances Act in these cases.

If an online HCG clinic is offering to prescribe HCG without a physical examination (a face-to-face encounter), then either the doctor writing the prescription is in violation of the State’s Medical Board regulations, or is operating in a State that currently hasn’t addressed the issue or could be in violation of Federal Law.

Whether it’s HCG or another prescription drug, the Federal Government is making inroads to prohibit the practice any way it can.

Don’t Do the HCG Diet Until You’ve Done This First!

January 30, 2009

The HCG Diet works like nothing else, but it is a solution of last resort for people that have a serious problem with their weight due to metabolic imbalances.

Instead of injecting HCG as a first step, this should be the last step in the battle of the bulge.  Granted, it will work, but it isn’t without ANY risk.

Therefore, BEFORE TRYING THE HCG DIET, read and implement the following little-known weight loss secrets (they’re FREE):

The Fastest Way to Lose Weight – Best Kept Secrets Revealed

If you can’t lose the weight by doing the steps outlined at the above page, the HCG Diet is for you.

hCG Diet Failures

January 2, 2009

Some claim that the hCG Diet is 100% effective, and others claim it doesn’t work at all and it’s a scam.  What are we to make of those that say they are hCG Diet Failures, and using hCG for weight loss didn’t work for them?

We have researched and documented extensively that those making claims that the hCG Diet is a scam are simply wrong.  You can read a great post about it here:

hCG Info – Just the Facts, Please!

So when people say the hCG Diet didn’t work for them, that they did NOT achieve success with the hCG Diet, what went wrong?

First off, there are 2 kinds of hCG weight loss failures:

  1. Not losing SIGNIFICANT weight with the hCG Diet
  2. Not keeping the weight off AFTER the hCG Diet

Let’s address #1:

Nobody would be interested in taking hCG injections for weight loss and adhering to a 500 calorie diet if it wasn’t DRAMATICALLY effective.  If you want to lose 1-2 lbs. per week, there are a lot of ways to do that, and if you are looking into the hCG Diet, you have most likely TRIED all of these methods (eating sensibly, exercise, weight lifting, etc.)

The appeal of the hCG Diet is the RAPID fat loss that is achieved – 5-10 lbs. per week is common (yeah, you read that correctly).

So when someone starts on the hCG Diet and does NOT achieved fast weight loss, this is considered an hCG Diet Failure.

What went wrong?  Here’s a list of top reasons someone might not achieved great results with the hCG Diet:

The other group of hCG Diet Failures are those that lost the weight with the hCG Diet but failed to keep it off (see #2 above).

Since the hCG Diet is touted as a ‘CURE‘ for dieting – it resets the metabolism and ends the need to diet EVER AGAIN – if one doesn’t PERMANENTLY keep the weight off with the hCG Diet, that would be a failure.

So why do some people fail to keep the weight off and enjoy the benefits of the hCG Diet Cure?

Here is the top reason (and maybe the ONLY reason):

Not following Dr. Simeons original program that REQUIRES eating a low/no-carb diet for 3 weeks after completing the hCG Protocol

Some clinics sell hCG weight loss programs along with Vitamin B-12 injections, colon cleansing regiments, etc. because they fail to follow the original protocol developed over 60 years ago by Dr. Simeons.

They are doing their patients/customers a disservice and causing needless failures with the hCG Diet. Sticking to the original protocol by Dr. Simeons guarantees success.  This means one MUST:

Failure to follow the above will result in either sub-optimal results or hCG Diet Failures.

Truthfully, many people cheat and still lose a ton of weight, so if cheating is something you plan to do, you will still achieve remarkable results (only not AS remarkable!)

Does Oral HCG or Sublingual HCG work? Or is it a Fraud?

January 1, 2009

According to David L Walters, DO, Ph.D., the use of Oral hCG or Sublingual hCG is an ineffective method of delivering hCG to the body for use in the hCG Diet.

From an article published on his website (www.diet-hcg.com/oral-hcg.html), he claims:

The short answer to the above question is YES, oral HCG and sublingual HCG is a complete and utter fraud. HCG is only biologically active when injected into the body via a hypodermic needle. This fact apparently does not stop numerous web sites from offering “oral” or “sublingual” forms of HCG for sale in order to avoid the need for injections.

But since we are only interested in the TRUTH here at HCG Diet Facts, a (very little) bit of investigation uncovers this from HIS OWN ARTICLE:

“On treatment days 0, 15, and 30 we have tested all volunteers, screening for the presence of plasmatic hCG. Concentrations were undetectable in all cases (data not shown).”*

*Utility of an oral presentation of hCG (human Choriogonadotropin) for the management of obesity. A double-blind study. By D. Belluscio, L. Ripamonte and M. Wolansky. Published on D. Belluscio’s website www.hcgobesity.org.

OK, so far so good, EXCEPT if you follow the link to Dr. Belluscio’s website (oralhcg.com), you will find THIS:

The Oral hCG™ Method is a medically designed protocol, based on the Simeon’s weight loss protocol, that has brought excellent results to more than 6,500 patients treated by me and my collaborators over the last 17 years.

In other words, the article by Dr. Walters claiming Oral hCG is a complete fraud cites a double-blind study done by the Daniel Oscar Belluscio, MD., Founder and Director of The Oral hCG Research Center that conclusively proves Oral hCG is EFFECTIVE!

So, does Oral hCG (otherwise known as Sublingual hCG) work?

The doctor who claims it doesn’t is selling the hCG weight loss treatment in injection form, and cites a study by a doctor studying and using an oral hCG formulation to ERRONEOUSLY prove his case!

Who’s the fraud?

HCG Weight Loss Before and After Photos

December 30, 2008

NEW:  HCG Body Transformation Before and After pics

Bob Robeson and his wife LaRainne have been through the hCG diet and were kind enough to grant permission to publish his pics and story.  For more hCG Weight Loss Before and After Photos visit his site at:  When Health Matters.

This is just one example of the dramatic, life-changing effects that hCG Weight Loss can have.

The first pic shows Bob with a 46″ waist late February 2008.

The 2nd pic shows Bob with 36″ waist December 3, 2008.

290 lbs with a 46" waist!
202 lbs, 36" waist

This is what Bob said about his hCG weight loss experience:

“I started at over 300 lbs earlier this year, and for the first time
in my adult life I am in the 100′s.

This is after being at or close to 300lbs for 40 years.

I have been on every diet I could find through the years, even the
Medically supervised Optifast where I did not eat anything for 4
months, but soon as I started eating again the weight came back and
then some.

This program is so cool because once you are done you can eat again
and not regain the weight.

I was at 213 lbs for 4 months I and I ate well, not like I use to but
very well and stayed at 213 lbs.

Then I started this round and got to my record breaking low weight,
199.8, WOW.

Simply amazing

I wish this was FDA approve and I wish we could get the word out to
all obese people every where.

This program saves lives, how cool is that!

No Longer Obese
No longer have Diabetes
No longer have High Blood pressure
No Longer have high cholesterol
No longer have sore knees or feet
No Longer have the Arthritis pains
I Sleep better
Have a Love life again
Have more energy
Look and feel great.

My ending goal is still about 170lbs. But that mile stone will be for
the next round as we finish this round the end of Dec.

Happy Holidays to all.

Bob & LaRainne Robeson”

What is the hCG Weight Loss Cure?

December 23, 2008

A new article on the hCG Weight Loss Cure has just been posted on our main site.  Since the hCG Diet was recently made popular by Kevin Trudeau’s book ‘The Weight Loss Cure “they” Don’t Want You To Know About,’ it is important to note the differences between what Trudeau talks about in his book (there is no mention of hCG in his book!).

Oral hCG vs. Transdermal hCG vs. hCG Injections

November 23, 2008

I am often asked what the difference is between the various ways you can take HCG for weight loss.  There is Oral hCG, Transdermal hCG and the oldie but goody hCG Injections.  But what are the pros and cons, both in terms of convenience as well as effectiveness?

In truth, Oral hCG is a misnomer. You cannot take hCG orally in the true sense of term, because as soon as hCG hits the stomach, the digestive enzymes and acids in the stomach destroy the hCG.  So what people are calling ‘Oral hCG’ is properly known as Sublingual hCG (which means ‘under the tongue’).

Anyone claiming that you can swallow an hCG solution like any other liquid is misinformed
– it simply won’t work and will render the hCG completely ineffective.

OK, but does Sublingual hCG work?  Yes.  But the caveat is you need to take twice as much (2 doses daily versus 1 dose for injections or transdermal gel).

Also, hCG is very unstable once mixed into a solution, so the only way to take hCG sublingually is to either mix the solution at home from the hCG powder shipped to you (which is in a stable form) or to have the hCG solution shipped to you overnight in a refridgerated package.

As soon as hCG liquid is exposed to heat for any length of time, it is rendered ineffective.
Therefore, you have to either get your supply of sublingual hCG from a vendor that knows how to ship it refridgerated, or mix up your own batch.

The Injection form of hCG is typically shipped in 2 vials: the hCG powder and a vial of bacteriostatic water.  Before injecting the hCG, one mixes the powder with the special water and stores the solution in the fridge for the remaining cycle of injections (it will keep refridgerated for several months).  This has to be done in a sterile environment so you need to know what you are doing.

Transdermal hCG (or hCG Transdermal Gel) is a gel you rub on your skin and the hCG transfers through your skin.  The advantages are obvious: no injections, no need to taste the solution, and no need to dose twice daily.

However, hCG gel has the same unstable properties as the oral (sublingual) hCG – it becomes useless if exposed to heat.  Therefore, this form of hCG also needs to be shipped in a refridgerated package.

Due to this need for refridgeration, the price of pre-mixed oral hCG or transdermal gel is more expensive.  This extra cost is because of the blending and compounding needed to create the product as well as the added packaging and shipping costs.

For this reason, a lot of people opt for the hCG Injections (as unpleasant as this can be to most people) OR they simply acquire their hCG in powder form and mix their own sublingual solution at home.  There are various recipes that can be found online for mixing your own oral hCG – the only standardized solution is Releana, but that can only be purchased from a Releana provider, since it is a patent-pending version of sublingual hCG.

So what’s the best way to take hCG?

If cost is the chief concern (and trumps the unpleasantness of injections), you can’t get any less expensive than either self-injecting or mixing your own sublingual hCG.  The added cost of dosing twice daily required when taking hCG orally is balanced with the cost of syringes and assorted paraphrenalia needed when injecting, so it’s a wash.

If you can afford it, the Transdermal hCG gel is the most convenient and least intensive way to go, but costs a little more.  It’s also harder to find, although hCG providers that have hCG Transdermal gel can be found at:  HCG Clinics
