Homeopathic hCG - Another Diet Scam

Let’s get something straight right off the bat:  There is no such thing as Homeopathic HCG - so if you are using it instead of REAL hCG on Dr. Simeons hCG Diet Protocol and are losing weight, it is because of the 500 calorie diet.

This means muscle is being lost, you are starving yourself, and will not enjoy permanent weight loss because your metabolic set point is not affected (you aren’t taking hCG!)

HCG is a HORMONE - so what the heck is homeopathic hCG?  I’ll tell you - snake oil.

Anyone can lose weight on a 500 calorie per day diet, but without real hCG you are losing muscle and structural fat.  You will end up in a yo yo diet cycle as your body makes adjustments for the reduced caloric intake by slowing its metabolism.  Your weight loss will  be short-lived, and you will put the weight back on with a vengeance.

Look: The hCG Diet works, but it works FOR A REASON, which is the effect that hCG has on your hypothalmus and other regulartory glands and systems (that, frankly, isn’t well understood).

Anyone selling Homeopathic hCG is a snake-oil salesman and if you are losing weight, or have lost weight with it congratulations, but don’t be surprised when you put all the weight back on.

HCG Laws - Are Online HCG Clinics Legal?

The question of whether online medical weight loss clinics offering HCG are operating within the parameters of the law often comes up.  Do HCG Laws permit or forbid this practice?

If you have an email account, you most likely have received SPAM emails offering prescription medications from various sources.

Since HCG is a prescription drug, is it legal to sell it online?  What about an HCG weight loss clinic that will prescribe HCG sight-unseen?  Is completing an online ‘medical history form’ enough to write a valid, legal prescription for hCG?

From the FDA.gov website:

“Some Websites offer to prescribe medication
based only on a questionnaire. Is this a safe practice? Is it legal?

Unlike the traditional relationship between a patient and the patient’s
health care professional, some online practitioners issue prescriptions in
the absence of a physical examination or direct medical supervision. According
to the American Medical Association, a health care professional who offers
a prescription for a patient the practitioner has never seen before and based
solely on an online questionnaire generally has not met the appropriate medical
standard of care. As a result, patients may receive a drug that is inappropriate
for them to use and may sacrifice the opportunity for a correct diagnosis
or the identification of an underlying medical condition for which use of
the prescription drug may be dangerous.

It is a violation of the Federal Food, Drug, and Cosmetic Act to dispense
prescription drugs without a valid prescription. FDA will work with the states
to determine the validity of online prescriptions and to bring enforcement
actions under state law, federal law, or both, as appropriate. In addition,
several state boards of medicine have ruled that such practice is medical
misconduct and have fined and suspended the licenses of health care practitioners
who have prescribed drugs in this manner.”

So what does that mean?

The Government has a 3 part argument:

1) Under federal and state law, for a doctor to be acting in the usual
course of professional practice
, there must be a bona fide
doctor/patient relationship

2) Completing a questionnaire that is then reviewed by a doctor hired
by the Internet Pharmacy could not be considered the basis for a
doctor/patient relationship

3) A prescription based on an online questionnaire is not valid.

Even though this seems cut-and-dry, the fact is the DEA doesn’t have the authority to determine medical standards.

This has left the practice of online prescribing difficult to enforce on the Federal level, and now State Laws are being used to make the case that online prescribing violates Federal Law (namely, the Controlled Substances Act).

Based on the theory that since numerous States prohibit online prescribing, and a violation of State Law violates the ‘Usual Course‘ provisions of the Controlled Substances Act, this means the online prescription isn’t valid.

HOWEVER, this theory has the problem that except for Nevada and Virginia (at the time of this writing), no State says an online prescription is invalid.

Instead, there are around 28 States that address the problem by the State Medical Board calling it ‘unprofessional conduct’, which could result in disciplinary action including stiff fines, penalties or loss of medical license.

Until the laws are clarified regarding whether an ‘online encounter’ is a “sufficient examination” and “establishment of a valid physician/patient relationship”, enforcing current laws are difficult.

There are currently around 20 States that do not have provisions for enforcing ‘unprofessional conduct’.

Things are tightening up from State to State, so any existing States that are lax will probably adopt the model of other States that DO have provisions to enforce these requirements of “sufficient examination” and “establishment of a valid physician/patient relationship”.

This much is clear: the government does not like online prescribing and is doing what it can to prosecute it.

Even the “careful” distributors of online prescriptions often have problems
in their business models, such as selling to minors or having a
single doctor review hundreds or thousands of ‘online questionnaires’ per
day.

It is easy for the government to argue that
the prescription fails the basic standards of medical care and
therefore the distribution violated the Controlled Substances Act in these cases.

If an online HCG clinic is offering to prescribe HCG without a physical examination (a face-to-face encounter), then either the doctor writing the prescription is in violation of the State’s Medical Board regulations, or is operating in a State that currently hasn’t addressed the issue or could be in violation of Federal Law.

Whether it’s HCG or another prescription drug, the Federal Government is making inroads to prohibit the practice any way it can.

HCG Diet Doctors - What is Their Role?

Since hCG requires a prescription, one needs a doctor to write a prescription for hCG.  We just posted a new article to our main website about the role of HCG Diet Doctors

The issue is:  Most doctors are opposed to using hCG for weight loss.  They simply have not reviewed the research done by Dr. Simeons or investigate the efficacy of hCG for curing obesity.

Therefore, one has to find a doctor already involved in the hCG Diet, either because they have their own medical weight loss clinic, or they work at one or prescribe hCG at their own practice to those patients that inquire about it.

hCG Diet Failures

Some claim that the hCG Diet is 100% effective, and others claim it doesn’t work at all and it’s a scam.  What are we to make of those that say they are hCG Diet Failures, and using hCG for weight loss didn’t work for them? 

We have researched and documented extensively that those making claims that the hCG Diet is a scam are simply wrong.  You can read a great post about it here:

So when people say the hCG Diet didn’t work for them, that they did NOT achieve success with the hCG Diet, what went wrong?

First off, there are 2 kinds of hCG weight loss failures:

  1. Not losing SIGNIFICANT weight with the hCG Diet
  2. Not keeping the weight off AFTER the hCG Diet

Let’s address #1:

Nobody would be interested in taking hCG injections for weight loss and adhering to a 500 calorie diet if it wasn’t DRAMATICALLY effective.  If you want to lose 1-2 lbs. per week, there are a lot of ways to do that, and if you are looking into the hCG Diet, you have most likely TRIED all of these methods (eating sensibly, exercise, weight lifting, etc.)

The appeal of the hCG Diet is the RAPID fat loss that is achieved - 5-10 lbs. per week is common (yeah, you read that correctly).

So when someone starts on the hCG Diet and does NOT achieved fast weight loss, this is considered an hCG Diet Failure.

What went wrong?  Here’s a list of top reasons someone might not achieved great results with the hCG Diet:

The other group of hCG Diet Failures are those that lost the weight with the hCG Diet but failed to keep it off (see #2 above).

Since the hCG Diet is touted as a ‘CURE‘ for dieting - it resets the metabolism and ends the need to diet EVER AGAIN - if one doesn’t PERMANENTLY keep the weight off with the hCG Diet, that would be a failure.

So why do some people fail to keep the weight off and enjoy the benefits of the hCG Diet Cure?

Here is the top reason (and maybe the ONLY reason):

Not following Dr. Simeons original program that REQUIRES eating a low/no-carb diet for 3 weeks after completing the hCG Protocol

Some clinics sell hCG weight loss programs along with Vitamin B-12 injections, colon cleansing regiments, etc. because they fail to follow the original protocol developed over 60 years ago by Dr. Simeons. 

They are doing their patients/customers a disservice and causing needless failures with the hCG Diet. Sticking to the original protocol by Dr. Simeons guarantees success.  This means one MUST:

Failure to follow the above will result in either sub-optimal results or hCG Diet Failures.

Truthfully, many people cheat and still lose a ton of weight, so if cheating is something you plan to do, you will still achieve remarkable results (only not AS remarkable!)
